Terms and Conditions for Digital Technology Solution

 These Terms and Conditions (“Terms”) govern your access to and use of the digital technology solution e-Learning services provided by Digital Technology Solution (“Company”). By accessing or using our e-Learning platform, you agree to be bound by these Terms. Please read them carefully before proceeding.

Acceptance of Terms

By accessing our e-Learning platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any additional terms and conditions that may apply to specific services or features offered by the Company.

In order to access certain features of our e-Learning platform, you may be required to create a user account. Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity

Uploading, posting, transmitting, or otherwise making available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another’s privacy

Interfering with or disrupting the operation of the e-Learning platform or servers or networks connected to the platform

Engaging in any activity that may compromise the security or integrity of the platform or any other user’s account or bullying.

Third-Party Links: The e-Learning platform may contain links to third-party websites or resources. The Company is not responsible for the availability, accuracy, or content of such external sites or resources. You acknowledge and agree that the Company shall not be liable for any damages or losses arising from your use of or reliance on any third-party websites or resources.

Intellectual Property

The e-Learning platform, including its content, features, and functionality, is owned by the Company or its licensors and is protected by intellectual property laws. You may not use, copy, reproduce, modify, distribute, transmit, display, perform, or create derivative works of the platform or any part thereof without the Company’s prior written consent.

Disclaimer of Warranties

The e-Learning platform is provided on an “as-is” and “as available” basis. The Company makes no representations or warranties of any kind, whether express, implied, or statutory, regarding the platform or its content, including any warranties of merchantability, fitness for a particular purpose, or non-infringement. The Company does not warrant that the platform will be error-free or uninterrupted, or that any defects will be corrected.

Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly as a result of accessing or using the e-Learning platform.

Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the e-Learning platform, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

Modification and Termination

The Company reserves the right to modify or terminate the e-Learning platform, or any part thereof, at any time without prior notice. The Company may also modify these Terms from time to time, and such modifications will be effective upon posting on the platform. Your continued use of the e-Learning platform after any such modifications will constitute your acceptance of the modified Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of South Africa. Any dispute arising out of or relating to these Terms or your use of the e-Learning platform shall be exclusively resolved by the competent courts located in South Africa.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and the Company regarding your use of the e-Learning platform and supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and the Company.

By accessing or using the e-Learning platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. If you do not agree to these Terms, you should not access or use the platform.
